buildingTemporary Residences: 

The department inspects and issues permits for all Hotels and Motels under this subpart. Temporary Residences are facilities maintained primarily for overnight occupancy by 10 or more people but are not intended to be occupied by the same persons in excess of 180 consecutive days. Temporary Residences are required to be maintained in a safe and sanitary manner. 

Annual inspections are made for, but not limited to, the following:

  • General cleanliness
  • Adequate water supply
  • Adequate sewage treatment/disposal
  • Adequate plumbing
  • Fire Safety (shared responsibility with local building and fire code officials)
A swimming pool, spa or bathing beach operated as a part of a temporary residence shall be included under the permit but shall be maintained and operated so as to comply with the provisions of Chapter I, State Sanitary Code, Part 6 – Swimming Pools.

Application for a permit to operate a temporary residence shall be made at least 30 days before the first day of proposed operation of such temporary residence.

Mass Gathering:

A Mass Gathering is defined as one which is likely to attract 5,000 people or more and continue for 24 hours or more but shall not include a temporary residence under permit.

Application for a permit to promote or hold a mass gathering shall be made at least 15 days before the first day of advertising and at least 45 days before the first day of the gathering.

  • Sanitary Code of the Niagara County Health District Chapter VI.
  • New York State Sanitary Code – Chapter 1, Subpart 7-1.
