Offensive Material

NCDOH's Offensive Material Program provides services to protect the citizens and visitors of Niagara County from adverse health effects attributable to improper generation and disposal of offensive materials. These materials are those deemed to be a nuisance or prejudicial to health and include such things as sewage, dead animals, petroleum products and hazardous wastes. The provisions of this section of code provide for the proper handling, transportation and disposal. NCDOH holds any person or persons discharging, dumping, spilling, or disposing of offensive materials strictly liable, without regard to fault, for all cleanup costs and may be liable for further civil or criminal penalties.

Solid Waste Disposal

The purpose of this program is to protect the public health and the environment from the effects of improper storage, collection, transportation and disposal of solid waste including flies, rodents, scenic blight, public nuisances and water pollution. "Solid Waste" refers to garbage, rubbish, ashes, incinerator residue, street cleanings, dead animals, offal, construction and demolition debris, waste tires, solid commercial and industrial. These rules and regulations promote sanitary conditions by minimizing the contamination threat to ground water, surface water, air, and soil, and protect the public from potential disease transmission.
The NCDOH randomly inspects solid waste management facilities including compost debris, waste tire collection/processing centers and material recovery facilities. It also investigates complaints related to these facilities.
